1.Eligibility:

Following are the rules which apply to your participation in the “SCOOP® CHALLENGE” (Hereafter: “Challenge“). The Challenge is organized by Danziger “Dan” Flower Farm / Much flowers &  Potomac Floral Wholesale (Hereafter: “Danziger”).  The Challenge is open to all florists and flower designers independently or together with a marketing company / wholesale/ importer. The Challenge is subject to all applicable federal, state, and local laws and regulations.

2. Agreement to Rules:

By participating in the Challenge (“You”) agree to be fully unconditionally bound by these rules, and You represent and warrant that You meets the eligibility requirements. In addition, You agree to accept the decisions of  Potomac Floral Wholesale | Much Flowers | Danziger final and binding as it relates to the content of this Challenge.

3 .Challenge Period:

Photos should be sent to Danziger no later than March 30th 2020.

4. Rules of participation:

1. Participation in the Challenge is free of charge.
2. In order to participate in the Challenge You will have to fill out the online application form published on http://danzigeronline.com/cmp/scoop-challenge-2/

 follow the direction provided .

5.Photographic criteria:

The chosen photo must be fully owned by You and in your sole responsibility.

1. You must provide the information requested.
   1. 1. The photo should not include any people in a form that they can be recognized.
      2. The photo must be, high resolution photo (2MB or more).
      3. The bouquet must be composed of at least 2 of Danziger’s  SCOOP® varieties.
      4. You must use the commercial names as indicated in Danziger’s catalog and website to describe the different varieties you used in the bouquet.
      5. Eligibility of any participant will be at the sole discretion of Danziger.

6.What’s in it for me?

The chosen participant (the “Participant”), will have their photo published at Danziger’s  / Much flowers exhibitions in catalogs and website with credits to the Participant’s business website, photographer and the flower designer. 

8.Participant Selection and Notification:

The Participant will be selected by a dedicated Danziger & Much flowers team chosen to this purpose, under the supervision of Danziger and in its sole discretion. The Participant’s name will be published in Danziger’s/Much flowers/Potomac  catalog and in different social media websites including: Danziger’s/ Much Flowers/Potomac  official Facebook page and Danziger’s/Much flowers/Potomac  official website. Participant will be notified by email and/or telephone (in case available), within two weeks upon their selection. Danziger/Much flowers/Potomac  does not guarantee that all Participants will have their photo chosen and published by Danziger. Danziger shall have no liability for Participant’s failure to receive notices due to spam, junk e-mail or other security settings or for Participant’s provision of incorrect or otherwise non-functioning contact information. Receipt by Participant of the prize offered in this Challenge conditioned upon reasonable cooperation from the Participant and compliance with any and all federal, state, and local laws and regulations. Any violation of these official rules by Participant (at Danziger‘s sole discretion) will result in Participant’s disqualification, and all privileges will be immediately terminated. 

9. Rights Granted by You:

By entering to this Challenge, You understand and agree that Danziger, anyone acting on behalf of Danziger and Danziger’s licensees, successors, and assignees, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, your name, portrait, picture, voice, image, statements about the Challenge and the photo uploaded, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes, without any further compensation, notice, review, or consent. You understand and agree that even if your photo is not published by Danziger immediately, Danziger may still use it for promotions subject to proper credit. By entering to this Challenge, You represent and warrant that your photo is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of Danziger. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Danziger from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Danziger may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

10. Terms & Conditions:

Danziger reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Challenge. Danziger reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the process of the Challenge or the operation of the Challenge or website or violates these Rules. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Challenge may be a violation of criminal and civil laws. Should such attempt be made Danziger reserves the right to seek damages to the fullest extent permitted by law.

11. Limitation of Liability:

By entering, You agree to release and hold harmless Danziger and its Employees and licensees from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrants’ participation in the Challenge and/or their acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the challenge; (v) electronic or human error in the administration of the challenge or the processing of entries.

12.Disputes:

This Challenge governed by the laws of Israel, without respect to conflict of law doctrines. As a condition of participating in this Challenge, You agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Challenge, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Israel.
